Rental house with Ex, he collects rent, but stopped paying mortgage. We are three months behind w/ mortgage.?

Can I petition the court to have the renters pay me so I can start paying the mortgage? My Ex and I also own a boat and motorhome together. Our divorse called to have them both sold & the profits split. He wanted them both and we wrote up a sales agreement. It's been 2 years and he has never paid me. Can I ask the court to give them to me (title in my name alone) so I can sell them. The money will pay me the amount we agreed on (for my half) and the remainder can go to pay some of back mortgage with the rest?

1. he does has to give you the half that belongs to you, do not waste more time go to a court and they should help you there, and with that money pay whatever you need to pay. i do not think that the court can make your renters pay you, but you can not kick them out of the place either you should contact a lawyer who can help you with this because think they can even make your ex pay you more money for taking so long to give you your money..... your renters have to pay you obviously and now that is being 3 months you have to get an application that you can find in a court to give them a notice that if they do not pay they will have to leave the house and pay in within a certain amount of days.... do everything legally so you do not get in troubles later good luck!!

2. LOL, should go back and ask for your money back from your divorce attorney. These properties divisions should have been handled and finalized before the final divorce decree.

Now you need to talk to a real estate lawyer fast. If your name is on that mortgage, your credit is gonna be hurt too.
