Is possible to file a Declaration of Homestead on an RV? The RV (recreational vehicle) is being used as sole and primary residence. Would it be treated in a similar way as a mobile home in a mobile home park, where the mobile home owner does not own the actual land under the mobile home?
Southern Califoria Granfather Clauses regarding homes and recreational vehicles.? We have a small motor home/RV parked in our driveway. At least two other families in our neighborhood have RV's on their property as well. However one of our neighbors whom we had a tiff with complained to the city that we should not be allowed to have it parked in view of the street because it is so big and it is only used on vacations which are not frequent. We were told we had to move it by the city or face a fine. However one of the gentlemen from the city who gave us this info said that it was possible that there was a grandfather clause that might make it possible for us to keep the RV parked in the driveway. But it depended on the year the house was built (1973 in the 91730 zip code) and we had to find the clause ourselves. I called the county recorder but they didnt even know what a grandfather clause was. Please help.

My solution is a strait sales tax, say 30%, so all can pay for the American dream, equally. This lady down the street gets about $6k a month, from child support, ssi and/or ssd. Total taxes paid about $800 a year in property taxes on her rent. ANY THING that is required by the government, fee's, permit's, that cost money is a tax. I am being fined the wrong amount on a seat belt violation. How do i get it fixed? I was on my way to class the other day and was waiting for a red light to change when an officer asked me to pull over when the light changed green; mind you I had been at the red light for at least a minute or two before he hit his siren and tapped on my window. After we pulled into the parking lot of the nearby apartment complex, the officer cited me with a $123.00 seat belt violation, no other violations were mentioned what so ever. I looked it up, and a seat belt violation for a driver in Florida is only supposed to cost $30.00 and they can only get you for the violation if they stop you for a different traffic violation first. What can I do to argue this fine amount, either to get it thrown out entirely or at lest reduced. I don't mind paying $30 but $123 is excessive especially since I am a poor college student. "316.614 Safety Belt Usage (1) This section may be cited as the "Florida Safety Belt Law." (4) It is unlawful for any person: (a) To operate a motor vehicle in this state unless each passenger and the operator of the vehicle under the age of 18 years is restrained by a safety belt or by a child restraint device pursuant to s. 316.613, if applicable; or (b) To operate a motor vehicle in this state unless the person is restrained by a safety belt. (5) It is unlawful for any person 18 years of age or older to be a passenger in the front seat of a motor vehicle unless such person is restrained by a safety belt when the vehicle is in motion. (6)(a) Neither a person who is certified by a physician as having a medical condition that causes the use of a safety belt to be inappropriate or dangerous nor an employee of a newspaper home delivery service while in the course of his or her employment delivering newspapers on home delivery routes is required to be restrained by a safety belt. (b) The number of front seat passengers of a pickup truck required to wear a safety belt pursuant to this section shall not exceed the number of safety belts which were installed in the front seat of such pickup truck by the manufacturer. (c) An employee of a solid waste or recyclable collection service is not required to be restrained by a safety belt while in the course of employment collecting solid waste or recyclables on designated routes. (d) The requirements of this section shall not apply to the living quarters of a recreational vehicle or a space within a truck body primarily intended for merchandise or property. (7) It is the intent of the Legislature that all state, county, and local law enforcement agencies, safety councils, and public school systems, in recognition of the fatalities and injuries attributed to unrestrained occupancy of motor vehicles, shall conduct a continuing safety and public awareness campaign as to the magnitude of the problem and adopt programs designed to encourage compliance with the safety belt usage requirements of this section. (8) Any person who violates the provisions of this section commits a non moving violation, punishable as provided in chapter 318. However, except for violations of s. 316.613 and paragraph (4)(a), enforcement of this section by state or local law enforcement agencies must be accomplished only as a secondary action when a driver of a motor vehicle has been detained for a suspected violation of another section of this chapter, chapter 320, or chapter 322. (9) By January 1, 2006, each law enforcement agency in this state shall adopt departmental policies to prohibit the practice of racial profiling. I have heard that the average person works for the government till June or July to pay taxes, true? If it were just income taxes, then I would would say it is not true. Factor in all the other taxes, isn't it plausible that Joe Six Pak doesn't earn a dime for the first six or seven months, that it all goes to the government, from local clear up to federal? Isn't calling a tax something else, like a fee, fine, toll, whatever, that it is still a tax considering it all goes to government? Or how about indirect taxes, like import tariffs that you the consumer end up paying? HOA Covenants clarification - definition of "passersby"? Our HOA Covenants state the following: "There shall be no recreational vehicles, trailers, boats or boat trailers parked in driveways or in the front of the dwellings, over night, nor may they be stored in the front of a lot on any permanent basis. Any such storage must be in the rear of the dwelling, out of sight from passersby." Some residents have boats, but live on a corner lot. They store their boat in their back yard where it can't be seen by passersby in front of the house. It can obviously be seen by every other angle due to the location of their house. I have a large back yard with no houses behind me which ends in a hill, allowing me to store anything in the back yard. Nothing can be seen unless passersby are on the side of my property. Some people have blatantly disobeyed obvious rules of our HOA and are claiming a number of us are not complying with the rules since they can see boats, campers, trailers, etc. from angles other than the front of the homes. Should the statement "Any such storage must be in the rear of the dwelling, out of sight from passersby." alleviate home owners from the issue of seeing items from any angle other than the front of the house? Actual definitions are too vague and I'd like some professional opinions from realtors or others involved in HOA-related issues.

Smoking allowed on apartment deck or not? I'm sorry that this is a bit lengthy; I have a confusing situation regarding smoking. There is a wrap-around deck on each floor of my apartment building that also serves as a walkway to get the each apartment's door. New tenants just moved in below me this week and have been smoking on the deck. No one else in this 8 unit building smokes on decks. I believe their smoking is in violation of the lease but I wanted to make sure before contacting my landlord. (If it's not in violation of the lease I'll politely ask them to smoke elsewhere on hot days so that smoke doesn't drift in through our windows. We've got to keep the windows open to keep the place cool as there is no AC). We have a lease document and an apartment rules document. Everyone has the same lease except for the two people who had their dogs grandfathered in before the building went pet-free. Where I get confused is that there is a section on the lease that says this: "Special Stipulations: The following stipulations shall control in the event of a conflict with any other portion of the apartment lease... 3) Tenant acknowledges receiving a copy of ___ Realty Rules & Regulations and will abide by them." The separate rules document says, "No smoking inside the building" and does not specifically prohibit smoking outside. However the very next section in the lease states: "Use restrictions Tenant shall not use the property or dwelling for the following purposes without written consent from the management which may be withheld for any reasons: 1) Boat(s), trailer(s), recreational vehicles(s), ..... 4) NO SMOKING ..." So the lease would prohibit smoking on the decks or anywhere on the property as well as inside since it also addresses parking lot issues, correct? Also the “dwelling” would refer to the entire building?? So is smoking prohibited on the decks?

I am not asking for an answer, just ideas- in regards to Sales of goods act NSW. any advice? a couple went to 'central adventure tours' a caravan dealer & said they wanted to travel australia. the dealer recomended a van named 'exel' & they took it- as they started travelling the hit a put hole & the axel broke. they discovered the van exel was not designed 4 rough roads but only to sit in a van park..... would they be entitled to any action against the dealer re; sale of goods act, if so what & how- Would this be different if it was called recreational vehicles pty ltd? & why do the fair trading acts in various states mirror the trade practices act 1974 (cth)?? Would you check to see if there are awkward expressions? Q : What do you think about the RV(Recreational Vehicles) lifestyle? A : It sounds interesting. However, I prefer just staying at home. Experiencing it for a short period of time might be fun, but basically I want more stable lifestyle. Plus, it doesn't fit my country's circumstances. My country is small unlike the U.S. or Canada. It is not easy even to find parking places for our personal cars. Some people lease RV for holidays, but living that way for a few months is not common in my country. A few weeks ago, I saw the family living in RV on TV. The wife complained that she couldn't take a shower or wash dishes comfortably, but as times went by, she seemed to enjoy the nature. They have three kid- one is five, second one is three and the last one is only one year old. Their children look happy. They played with trees, flowers and bugs. Also, they cooked with their parents after digging out plants. These days a lot of kids are used to playing with computer games and which is a big issue in this society. In that aspect, living in RV looks good.
Can I have them towed? My neighbor's housekeeper keeps parking in my yard. I've told him in person not to and left a note on his windshield not to. Can I have him towed at his expense? Not sure what else to do because he's in the way! How my human right was violated in the Land of Free? I am a 25-year-old Asian (Taiwanese) American who just became American citizen this February. Already studied for 7 years and worked for 1 year in the United States, I once had a positive perspective and a bright future on the Land of Free until my incident in Wayne National Forest. When I camped in the Wayne National Forest on Friday, June 25th in 2010, I attempted to ask questions about camping when I saw a park ranger. After he answered me, he simply asked me to lean on the front of his vehicle, and ordered me to take out the driver’s license. After that, he insisted that I was under the influence of drug because “I looked nervous.” Then, he cuffed me and started searching my tent and vehicle with my stuffs. Since I was very shocked, I originally thought that he would let me go once he finished searching. However, I was wrong. When he searched my vehicle, he took out my medicine (just cold medicine, antibiotics, or the medicine which does not need prescriptions), given my parents who were a licensed pharmacist and a physician from Taiwan, and insisted that it was “drug” and I was distributing drug. I attempted to explain to them, he asked personal questions like “did you steal from your parents?” or “since you have bags of drugs, you must distribute it,” “how long have you used drug,” or “are you kicked out by your school”. As a student who graduated with 3.6 GPA and never touched any form of recreational drug in my whole life, I felt humiliated and angry; I doubted why this ranger can search my vehicle when I only wanted to ask questions. Later he took out my medicine and tried to call other policemen for handling me. I was still cuffed. After the policemen from the Athens County arrived, I explained my circumstance, but the ranger simply said that he doubted me because “I looked nervous”. I insisted: “Of course I am nervous because he cuffed me for no reason. This ranger continued to say that I was under drug. If you want, I will volunteer to have an urination test and see whether I am under the influence of drug.” The county police told me that “they wanted to trust me” but they would not take my urination test; instead, they took my medicine away and told me that they would test it. Once they were done with the test, they claimed that they would send a court ticket back to me. This legal incident has brought me several troubles. As a tourist, I currently don’t have a permanent address in Ohio. Even though I sent the Court a letter and asked them to change the address to an office of the NGO, I was not sure that they receive it. My life was burned out here because I could go nowhere but staying in Athens. I even needed to worry about the bad record, which may jeopardize my future. Most of all, I lost interest in camping because I refused to trust in the rangers, who, instead of helping people, wrongly accused the innocent tourists for fun. Because of this incident, I not only lost my faith in the ranger and the policemen, but America which promised human rights for its citizens. I attempted to share this story because I want to raise the awareness how American park rangers can abuse their power to tourists who simply needed help. You repo cars for a living, what if an order comes in with family members name? Here's the thing, My husband has a job that, at times requires him to go pick up vehicles who's owners are behind. About 2 months ago a family members name came up. We decided not to do it at that time because it felt bad to have to do it. Calls were made from the company to the owner (family member, who we don't talk to much at all) to get a payment arrangement set up. The family member promised he would pay something on 'this day' then 'this day' and so on until two months went by. The car lot wants their car, they are loosing money daily and they need my husband to get it. My husband found out where the car is is parked at times but still hasn't went to get it, partly because other family members are telling me that I am horrible for 'allowing' him to go repo that car. I feel as though it's not up to me, that's his job. Not only that but I feel like 2 months to make an arrangement and now the family member won't answer the phone when the car lot calls them. Am I wrong for thinking that my husband should just go on and do the job? He doesn't really have a choice, it's what he does and if he doesn't get that one then the next order that comes in may go to someone else cuz the car lot might think that my husband isn't serious about his duties. Illegal to live in an RV? My boyfriend our 9 month old son and I live in a 32ft 5th wheel, on private property. We got a citation from the county, saying that it is illegal to live in any recreational vehicle unless you are in an RV park. So in 7 days we will be living on the streets/car. Does any one know any thing about this, or have had other expierences? And does any one know any way around it? Thanks in advance we are freaking out. Legally, can an employer ask for information about a medical strategy that is not used on company time? I have a license for medical marihuana. I use it for spasms and pain. I do not use it during work time, which requires me to never be impaired. I also do not use antihistimines, codienes, alcohol or anything else that says on the label it might cause impairment. I use it when I am able to be quiet in my home. I am allowed to carry a small amount with this license. I do that just in case I get a bad spasm and need to relax a bit just to get home (which is 3 min away). When I do the right amount I get relief from my symptoms, but do not get 'high' like I would with recreational use. The other day a supervisor saw me in my vehicle in the parking lot with a white stick. He asked what it was and I told him. He insisted I go home on sick leave and he reported this to higher up. Now the higher ups want me to ask my doc to give them information they could get on a million web sites....and are asking how does this affect my work time state. Do they ask how using antihistimines might affect a workers state? I don't think anyone has the right to force me to provide all and any medical history unless it is in direct concern for my impairment levels......and I don't think they can FORCE a doctor to do the research they can easily do themselves. Recreational Vehicle parking? i need to know if there is any regulations to Recreational Vehicle parking with in city limits.. because down the street from me a guy has parked an RV and it blocks the road so you cant see if anyone is coming down the road..i have almost gotten hit more than once. the police say there's nothing they can do because he is not breaking any laws. but there has to be some kinda of law stating that you cant park an RV with in city limits for so long. the RV has been there for over 3 months now. it needs to move before someone gets hurt. i need help on this. any information or websites that might help are greatly appreciateed.

easement on my property? We have an easement on our property for view shed. The new owners of the property that are entitled to the easement have started parking recreational vehicles, etc. on our property. Last week they decided to have loads of dirt and gravel brought in to bring the sloped property up to street level and build an ice arena in the easement. When we confronted them acted as they owner the property and only a small portion could be on our property. We explained this was opening us to possible law suits if someone got hurt. It appears to us, they believe they own the land within the easement.

Living on acreage in a recreational vehicle year round, is such a thing possible? My mother absolutely refuses to buy a manufactured home and doesn't want to let go of her RV. So, is it really possible to live in an RV on acreage that you own, year round? We've been looking at county laws and it looks like such a thing really doesn't exist. She wants acreage in Oregon, if anyone is familiar with county laws there and knows such a place where you can camp out in an RV all year round. She does not want to live in an RV park or anything like that. I don't blame her, no privacy. How is it even possible that you can live in an RV park year round, but not acreage that you OWN? Can you buy a permit that makes it possible to live on your acreage year round or anything like that?

Getting out of a lease/lack of information about HOA? We recently rented a townhouse in a community with very limited parking. My husband is a contractor and owns a trailer that he uses for his business from time to time. Our trailer is sitting in our driveway when not in use and yesterday we received a letter from the HOA saying that no recreational vehicles such as boats, trailers etc are allowed to be parked on community property. I contacted the HOA asking for asistance, since we HAVE to park it somewhere and it needs to be accessible. Plus we don't want to have to pay to have it parked wherever. The HOA was not very helpful and bascially let us know that it's our problem, not theirs... When we signed the lease etc we have never seen any HOA policies and weren't made aware of any rules like that. Can we get out of the lease because of that? I think it's ridiculous that we can't park our trailer in OUR driveway that's part of the property thatw e pay rent for!!! Home owners assoc question? ? Need consensus. Trying to obtain a "3rd vehicle permit". We have a 2 car garage. We have a total of 3 vehicles: car, truck, cruiser motorcycle. Currently, the car and motorcycle are in garage. We are unable to obtain a 3rd vehicle permit to have the truck parked inside the association gate because the hoa deems a motorcycle is not a "standard passanger vehicle". Per california vehicle code 34710, a motorcycle is a passenger vehicle. I am stumped on the meaning of "standard". Our hoa has not defined standard....but I have looked up the defination of standard in the dictionary. I am leaning towards that our motorcycle IS a passenger vehicle...per the cvc. And our hoa is in correct in denying our request for a 3rd vehicle pass for our truck. I don't know if they are thinking its a "recreational vehicle"...which it clearly is not! What's your take? Would you vote for me if I ran for president? Here are my policies: Foreign Policy: Strengthen our ties to countries like India, South Korea, and Japan. Respond to terrorism with surgical strikes but not outright war. Continue our aid to Israel and other countries but decrease it ever so slightly. Homeland Security: Continue as is but scale down TSA searches and make more extensive use of unarmed drones on the US/Mexico border. Immigration: Continue as is, I have no problem with current immigration policies. Energy & Oil: Scale down our dependence on foreign oil by encouraging growth in the solar industry and electric vehicles. A network of high speed electric bullet trains much like the one in Japan would also be nice. Gun Control: I would not make any specific types of guns illegal but rather types of ammunition that are excessive for civilian use, such as armor piercing rounds and explosive bullets. Crime: I would make our prisons more focused on rehabilitation rather than punishment so that we have a lower reoffender rate and thus less crowded prisons. Drugs: Legalize marijuana for personal/medicinal use (you cannot use it in public and most definitely not while driving or otherwise operating heavy machinery).
